Rice & Thompson v Secretary of State for Trade and Industry & ors. - QBD 26.5.06

Messrs Rice & Thompson both contracted asbestos related diseases while working at Liverpool docks in the 1960's. Their employer at the time has since been wound up. They made claims against the DTI on the basis that Liverpool Docks were at all relevant times subject to the "National Dock Labour Board" regime and that the DTI took over the NDLB's liabilities when it was wound up in 1989. On a preliminary issue, the High Court has decided that a duty of care was owed to Messrs Rice & Thompson by NDLB. The case can therefore go to trial if a settlement is not reached.
