Unison v Leicestershire County Council - raising new points - redundancy and protective award - CA 29.6.06

The Court of Appeal has unanimously allowed an appeal in this case by Leicestershire County Council, and dismissed a cross-appeal by Unison, on the amount of a protective award for failure to consult before making staff redundant. However it has upheld an important part of the EAT's ruling. It has held that the EAT was correct to refuse to allow points to be taken before it which had not been taken before the original tribunal.
