Kiani (as Personal Representative of the late Abdul Kiani) v Land Rover Limited and Castrol - Health & Safety - employee's death - Court of Appeal, 28.6.06

A County Court judge ruled in July 2005 that Land Rover and Castrol were liable in respect of a claim brought by Mr Kiani for damages for the death of his father. The father was a cleaner at the Land Rover plant in Solihull who had died of asphyxia after falling into a sub-floor tank full of coolant, which was maintained by Castrol. A coroner's jury had returned an open verdict. Mr Kiani said his father's death was accidental while Land Rover and Castrol said it was suicide. The judge agreed with Mr Kiani and the Court of Appeal has now dismissed an appeal by Land Rover and Castrol.
