Brunsdon v Pattinson & Brewer (1) and NURMTW (2), High Court, 29.6.06
Mr Brunsdon was a signalman who wished to claim unfair dismissal against his former employer, Railtrack. He had suffered from migraines and was involved in a couple of safety incidents before he was dismissed after 11 years service. His potential unfair dismissal claim was out of time so there was no way that it could be entertained by an employment tribunal. He now sued his union, the RMT and their solicitors, Pattinson & Brewer, who were acting for him, for negligence.
