Irish law provides that chemists shops can only dispense medical prescriptions if certain conditions are fulfilled including that they have been in operation for at least 3 years. Mr Sajda claimed that the mechanics by which this restriction had been implemented were unlawful under Irish law essentially on the basis that the restriction amounted to the exercise of a discretion under relevant EC law (EC Directive 85/433/EEC).
