Barracks v Coles & anor. - CA 21.7.06

At a preliminary hearing in a race discrimination claim an employment tribunal ordered the police to disclose reasons for refusing to move a black police constable to work as a field intelligence officer within the Operation Trident Shootings Desk. The EAT overturned this ruling. The Court of Appeal has now remitted the case for a full hearing by the employment tribunal on the basis that it was "wrong in law to prevent the police from defending the claim at least on the basis of evidence that they were not prohibited from adducing."
