Choudhury v Kingston Hospital NHS Trust - costs - [2006] EWHC 90057 2.5.06

The report of the costs appeal in this case has just appeared on BAILII. Ms Choudhury accepted a Part 36 offer in settlement of £5K plus payment of her reasonable legal costs in settlement of her claim for £250K. Costs, incuding a 100% success fee, were £68K. The Hospital failed on "six major challenges" to the bill and appealed. In general the appeal, including the challenge to hourly rates charged at £350 per hour and £270 per hour, failed. However the appeal achieved a reduction in the success fee element from 100% to 82%.
