Kitchen staff at an Italian hospital were employed on short fixed-term contracts. Their contracts were not renewed at the end of a six-month contract which expired in January 2002. They claimed that under relevant Italian law their contracts had been converted into contracts of indefinite duration and that therefore they were still employed. The hospital replied that under Italian law (Art 36 of Legislative Decree No 165/2001) public authorities are prohibited from concluding employment contracts of indefinite duration.
