Case CIS/3182/2005 - Decision of the Social Security Commissioner 1.9.06

A Dutch woman loses her appeal against a decision that she is not entitled to income support in the UK as she was not an employed person and thus had no right to reside in the United Kingdom. She could therefore not be treated as habitually resident in the United Kingdom for the purposes of the definition of a "person from abroad" in Income Support (General) Regulations 1987 SI 1987/1967 reg 21(3).
