Cadman v Health and Safety Executive (C-17/05) - legality of pay based on length of service - ECJ 3.10.06

The ECJ has NOT followed the advice given in the May 2006 opinion of Advocate-General Maduro. Instead it has ruled that, save in "inappropriate" cases, a pay system under which employees with long service and more experience get higher pay than those with short service and less experience does not infringe EU equal pay rules even though most of the latter are female and most of the former are male.
