Muller v Austria - delay in proceedings is a breach of Human Rights - ECtHR 5.10.06
An Austrian employer was prosecuted in 1994 for illegal employment of a foreigner without a work permit. The process was not finally completed until October 2002. The European Court of Human Rights has held that this delay was unreasonable and a violation of his human rights (although it rejected his claims concerning the amount of the fine and the burden of proof). The Austrian State was ordered to pay him EUR 4,000 damages and EUR2,000 costs.
