AB & ors. v British Coal Corporation & ors. - order for interest payment - Court of Appeal 19.10.06

This appeal concerns a case brought by former employees of British Coal who suffered from Vibration White Finger. The claimants lost their appeal for a specific rate of interest payment, but it was held that the judge did have the jurisdication to make an order for the payment of interest. The defendants also appealed, against "the judge's finding that the" Claims Handling Agreement "permits solicitors acting for claimants to recover a success fee where the agreement provides for the detailed assessment of costs and not for a fixed sum" but this appeal was dismissed.
