Lyfar v Brighton and Sussex University Hospitals Trust - continuing acts and time limits for discrimination claims - CA 14.11.06

At two different hearing tribunal chairmen ruled that 12 of Dr Lyfar's 17 race discrimination claims had been made too late and were out of time and of the remaining 5 only one could go ahead because she failed to activate the required grievance procedures in respect of the other 4. She maintained that the 12 "out of time" complaints were not out of time as they were all part of an act extending over a period, and that her claim had been made within 3 months of the last part of that single act.
