Commerzbank AG v Keen - Unfair Contract Terms Act 1977 and employment contracts - CA 17.11.06

The Unfair Contract Terms Act 1977 protects consumers against unfair contract terms. Can it apply to employment contracts? The High Court ruled in 1999 that it could (in Brigden v American Express). Now the Court of Appeal has expressly and categorically stated "An employee does not deal with an employer as a consumer".
