Steria Ltd. & ors v Hutchison & ors - doctrine of estoppel EWCA Civ 1551 on 24.11.06
Mr Hutchison (born in 1954) had various complaints about the way his employer's pension fund was run. Notwithstanding that the pension scheme provided for a normal pension age of 65, booklets about it and letters to him led Mr Hutchison to believe that if he completed 20 years pensionable service, he would be able to retire on full pension at age 62. The Pensions Ombudsman upheld his complaints on the basis that the employer and the pension fund trustees were estopped from denying what they had led Mr Hutchison to believe. The High Court dismissed an appeal.
