Buck & ors. v Nottinghamshire Healthcare NHS Trust - hospital's duty of care to staff [2006] EWCA Civ 1576 on 23.11.06

In 2001 six nurses employed by Nottinghamshire Healthcare NHS Trust at Rampton Hospital were assaulted and injured by a particularly disturbed and dangerous patient, Rachel Agar. They won a claim on liability against the Trust at Nottingham County Court (damages were not assessed) and the Trust appealed. The case turned on whether the Trust had been in breach of its duty of care to its employees in failing to ensure that Ms Agar was confined to her room at night.
