Fox Gregory Ltd v Spinks and Hamptons - costs when an ex-employee disclosed confidential information to a competitor - CA 4.10.06
A Mrs Spinks, an employee of Fox Gregory, went to work for a rival London estate agency, Hamptons. Fox Gregory considered that Mrs Spinks had taken a large quantity of confidential information with her and sued both Mrs Spinks and Hamptons. The case was settled out of court. The judge ordered Mrs Spinks to pay Fox Gregory's costs but refused to make the same order against Hamptons on the basis that there was no evidence against them and that they had undertaken to investigate (so suing them was premature). Fox Gregory has now won its costs appeal to the Court of Appeal and has won.
