This appeal concerned the circumstances in which a person who is a director of a company in insolvent liquidation may be brought within an exception to Insolvency Act 1986 ss.216 and 217 - provisions which would otherwise render that person liable for the debts and liabilities of a new company of which he is a director which is using a "prohibited name" (ie one which is so similar to the name of the company in liquidation as to suggest an association with that company).
