Lindorfer v Council of the European Union - sex discrimination - ECJ Case C-227/04, 30.11.06
The essence of Ms Lindorfer's claim was that the actuarial values used in the calculation of her EU Council pension were discriminatory on the grounds of both sex and age. This was dismissed by the Court of First Instance, but shortly afterwards the Council replaced the relevant rules in its pension scheme. Revisiting the case, the Advocate General has pointed out that "when officials are entitled to equal treatment - without reference, direct or indirect, to sex - anything which falls short of equal treatment is inadequate".
