Robb v Salamis (M & I) Ltd - Health and Safety - HL 13.12.06

Mr Robb worked on an off-shore rig and suffered injuries when he was getting out of his bunk bed. He brought a claim against his employers on the basis that the accident was caused by their breach of the Provision and Use of Work Equipment Regulations 1998. He lost. The case has now come to the House of Lords which overruled the previous decision and has ruled that the accident was caused by the employer's breach of its statutory duty under the PUWER regs but that Mr Robb was 50% responsible throughhis own negligence.
