Burlo v Langley & Anor - calculation of compensatory award on unfair dismissal - CA 21.12.06

This is an important Court of Appeal decision. In simple terms it confirms that if the terms of an employee's contract provide that during sick leave he or she is entitled only to statutory sick pay (''SSP''), then if he or she is dismissed without notice while absent on sick leave , compensation for the failure to give proper notice will be limited to SSP for the notice period to which he or she was entitled. However, that disguises important legal issues of considerable importance.
