Love v North Lanarkshire Council - employer's duty of care - Court of Session 23.1.07

A swimming pool attendant, James Love, was injured in the course of his employment when a plywood board which was leaning against a locker, slipped, causing a glass bottle to explode and cut his leg. The judge ruled that Mr Love's employers were in breach of their duty of care by "permitting glass bottles to be in and remain in a staff changing room which has showers and a hard floor". Their argument that it was not foreseeable that an accident would occur in the way it did was dismissed as "untenable."
