Dennis, R (on the application of) v DPP - criminal liability of employer on employee's death - QBD 29.12.06

Daniel Dennis, a 17 year old youth fell through a skylight while working as a labourer on a building site. Sadly he was killed. At the resulting inquest in March 2005 the jury returned a unanimous verdict of unlawful killing on the basis of gross negligence manslaughter. Particular reference was made to the duty of care owed to Daniel by his employer, a Mr Clarke trading as North Eastern Roofing. The Crown Prosecution Service decided not to prosecute Mr Clarke. Daniel Dennis's father applied for judicial review of that decision and the High Court has ordered the CPS to reconsider.
