Higham v United Kingdom - discriminatory failure to pay Widow's Bereavement Allowance did not cause real and serious emotional damage - ECHR 22.1.08

Mr Higham's claim, in 2000, for an equivalent benefit to Widow's Bereavement Allowance was rejected by the Inland Revenue. Extensive case law has established that this amounts to unlawful sex discrimination. UK law was changed accordingly in 2001. Claims for the pre-2001 period have mostly been settled and so dismissed by EtCHR (see, for example, Herbert v UK ECHR 22 January 2008).
