Mountford v Newlands School and Anor - vicarious liability of employer - CA 24.1.07

A 14-year old schoolboy, MM, broke his elbow as a result of a tackle during an under-15's rugby match. The tackle was carried out lawfully by another boy, RK, who was considerably bigger than MM but who was well over 15 years of age. Brigihton County Court held that the master who selected RK was in breach of a duty of care in selecting RK when he was over age 15, that the breach caused the injury and that Newlands School was vicariously liable.
