Malcolm v Dundee City Council - Time limits, bullying case - Court of Session 22.2.07

Ms Malcolm claimed that she had been subjected to harassment, bullying and abuse by two fellow members of staff at the school to which she was transferred in 1996. She had a short stress related absence in early 2002 and went off work in October 2002 by which time Dundee Council had instituted disciplinary proceedings against her. She felt so threatened that she resigned on 29th November 2002. She served a summons on 24th November 2005, claiming that she had been harassed contrary to Protection from Harassment Act 1997 s.8.
