Hynd v. Armstrong & Ors - ETO reason for dismissal under TUPE - Court of Session 27.2.07
Mr Hynd was an employed solicitor at the Glasgow office of Morison Bishop, solicitors. It was decided to divide the firm into two new firms one in Edinburgh and the other in Glasgow. Mr Hynd was made redundant by Morison Bishop prior to the transfer of the relevant part of its undertaking to the resulting Glasgow firm. He claimed that the principal reason for his dismissal was the transfer of an undertaking and that it was therefore automatically unfair under the TUPE regulations.
