Johnson v The Medical Defence Union - [2007] EWCA Civ 262 on 28.3.07

This a technical but important decision. Material is "data" for the purposes of those parts of the Data Protection Act 1998 which are not concerend with a "relevant filing system" only if it is being or is to be "processed by means of equipment operating automatically in response to instructions". The Court of Appeal has ruled in this case that a risk manager's manual selection of files for entering on a computer was not within this definition and therefore did not amount to processing of data for purposes of the Act.
