St Helens MBC v Derbyshire & ors - equal pay and victimisation - HL on 25.4.07

The House of Lords has ruled that 36 dinner ladies suffered unlawful victimisation at the hands of St Helens BC. The Council sent some 500 staff a letter warning that if they went ahead and won equal pay claims there would job losses and other consequences. Around 470 of them accepted a settlement totalling some £560,000 but the 36 ladies in this case fought on and issued proceedings. They were sent another essentially similar letter and hit back by claiming that the two letters together amounted to victimisation contrary to SDA 1975 s.4.
