Mainstream Properties Ltd v Young & ors - encouraging others to breach a contract - HL 2.5.07
The House of Lords has held that it is an essential prerequisite for establishing the tort of inducing a breach of contract that the alleged wrongdoer specifically intended to interfere with the contract. The tort is one of deliberately, not just carelessly or negligently, inducing such a breach. The House of Lords has upheld the Court of Appeal's July 2006 ruling to that effect. In the case, two directors of a property company called Mainstream formed companies of their own which they used to exploit opportunities available to Mainstream.
