Brander & Ors v Revenue & Customs - taxation of employment termination payments - Special Commissioners of Income Tax 23.4.07

A condition of new investment in a company referred to as NTM was a change in management. Negotiations with 3 of the company directors/executives led to their agreeing Compromise Agreements under which their employment was terminated by mutual consent in return for certain payments. The Special Commissioner has ruled on the facts that the payments were not payments due and payable under their Service Agreements and that the first £30,000 due to each of the 3 directors is free of tax (under ICTA 1988 s.148)
