CIB/3236/2006 - effect on incapacity benefit of combination of industrial and non-industrial injury - Social Security and Child Support Commissioners' Decisions 14.5.07

The Social Security Commissioner has ruled that where the combined effect of an industrial injury and other pre-existing disabilities is to make a claimant incapable of work, the incapacity is "as a result of" the industrial injury. By the same token if a claimant partly recovers from the effects of industrial injury but remains incapable of work as a result of the combination of the continuing effects of the injury and of a subsequently acquired condition the claimant would still be correctly described as incapable of work "as a result of" the industrial injury.
