Commission of the European Communities v Netherlands - Netherlands in breach of freedom of movement obligations - ECJ Case C-50/06, 7.6.07

The Netherlands has been found "guilty" by the ECJ of failing to fulfil its obligations to allow freedom of movement for nationals of EU Member States. In the case a number of EU citizens who were sentenced to imprisonment in the Netherlands had complained to the Commission about measures taken against them by the Netherlands authorities declaring them undesirable on public policy grounds.
