AB & Ors v British Coal Corporation (Department of Trade & Industry) - success for claimants in the Respiratory Disease Litigation - High Court (QBD) 27.6.07

This case is part of the British Coal Respiratory Disease Litigation. The DTI argued that to be entitled to compensation for Chronic Bronchitis, a claimant must in addition to establishing that he suffered from the disease and that the symptons were present when he was working in the mines also establish that it was caused, or materially contributed to, by his exposure to dust and/or fumes during his work underground at a British Coal Corporation mine.
