Morrish v. NTL Group - implied terms in employment contract - Scottish Court of Session 3.7.07

John Morrish, a former financial director and company secretary of NTL Group Ltd., was on a 12-month notice period when he was made redundant. His employers terminated his employment without allowing him to work out his notice, but did agree to make him payments in lieu of notice, together with additional payments "as compensation for loss of contractual benefits". However, Mr Morrish argued that they had breached the employment contract by not allowing him to work out his notice (which may have resulted in a higher degree of remuneration).
