Morrish v. NTL Group Ltd - no PILON term implied in employment contract - Scottish Court of Session 3.7.07
Under his contract, Mr Morrish, a director and company secretary of NTL Group Ltd, was entitled to 12-month's notice. There was no provision for pay in lieu of notice. He was made redundant but was not allowed to work out his notice. NTL was willing to pay him pay in lieu of notice, together with some additional payments "as compensation for loss of contractual benefits". Mr Morrish did not accept this. He argued that NTL was in breach of contract by not allowing him to work out his notice and that, because of bonuses, this would have resulted in a higher amount of remuneration.
