Luke v Stoke-On-Trent City Council - no work, no pay - Court of Appeal 24.7.07

Mrs Luke was a special needs teacher who went off sick following a dispute with her employers, Stoke City Council. Matters reached an impasse - the Council implemented a Report and Action Plan which it saw as the only way to get Mrs Luke back to work; Mrs Luke refused to accept the Report and so stayed off sick. Eventually the Council stopped her pay and she claimed this amounted to an unlawful deduction. The original tribunal and the EAT rejected Mrs Luke's claims, by implying terms into the contract. She appealed.
