Unite v Tyco Electronics - recognition of bargaining unit, CAC inquiries - CAC 25.7.07

Unite applied to the CAC for recognition of a bargaining unit at Tyco of "all shop floor employees not including management". There was dispute between Unite and Tyco as to how many staff might fall within such a unit and how many were actually unoin members. Before it can make a declaration of recognition, the CAC is obliged to be satisfied that the minimum requirements of TULR(C)A 1992 are met. Accordingly it conducted its own confidential inquiries to establish that 67% of the workers in the unit were union members and 78% supported Unite's application.
