Ashworth v Newnote Ltd - use of statutory demand procedure - Court of Appeal 27.7.07

Mr Ashworth was dismissed as a director of Newnote, and a series of claims and counter-claims regarding large sums of money allegedly owed by both parties to the other followed. The Court of Appeal, upholding the original decision of the Deputy District Judge, confirmed that the claims were complex and in fact arose in the context of an employment dispute. The issue was whether Newnote was entitled to summarily dismiss Mr Ashworth, and the statutory demand procedure, under the Insolvency Rules 1986, should not be used to decide this.
