Unite v Cadbury Trebor Bassett - majority non-membership of union is not automatically majority non-support for recognition - CAC 3.8.07

The Central Arbitration Committee assesses a number of requirements under TULRC)A 1992 when considering an application for recognition of a bargaining unit for collective agreement purposes. One of these is that the majority of workers in the proposed unit must be likely to support recognition of the union. The CAC has previously taken the view that this can be inferred if the majority of workers in the unit are union members and there is no other evidence to the contrary.
