Seabrokers Ltd v Riddell - restrictive covenant - Scottish Court of Session 15.8.07
This case concerns a post-termination restrictive covenant, in which Seabrokers Ltd attempted to enforce a non-competition "quarantine period" clause against an employee. Mr Riddell, the employee in question, was offered alternative employment at a competitor, gave notice and "duly served a three month period of garden leave". However, Seabrokers then obtained an "interim interdict" to enforce a restrictive covenant which prevented Mr Riddell from working for any competitor "for up to 12 months". The Court of Session "recalled the interim interdict".
