CIB/912/2007 - incapacity benefit claimant fails to disclose change in circumstances - Social Security and Child Support Commissioners' Decisions 3.8.07

The Darlington appeal tribunal ruled in favour of the DSS that £9,587.07 in incapacity benefit between 16 June 2003 and 22 June 2005 was recoverable from the recipient on the basis that he had failed to disclose the material fact that he was earning in excess of the permitted work lower limit as from the earlier of those two dates. The Social Security Commissioner has allowed the recipient's appeal to the extent that he has remitted the case for rehearing by a new tribunal.
