LLM v Secretary of State - name removed from POVA list - Care Standards Tribunal 7.11.07
LLM appealed against her inclusion on both the POVA and POCA lists (protection of vulnerable adults and of children). The Care Standards Act 2000 s.92(4) makes clear that if the Care Standards Tribunal is not satisfied that an individual is unsuitable to work with vulnerable adults they must remove a person's name from the list. The Protection of Children Act 1999 has similar provisions. Accordingly the burden of proof rests with the Secretary of State. In this case LLM had already been struck off as a nurse, but the CST held that, on balance, she was suitable to work as a carer.
