Birmingham City Council v Samuels - Court of Appeal to consider

The EAT decided, in Oyarce v Cheshire County Council, that the "reverse burden of proof" does not apply to victimisation claims under the Race Relations Act 1976. This creates an anomalous position and is, unsurprisingly, subject to further challenge.
