Commission v Italy - Italian national requirements for security firms unlawfully restrict freedoms of establishment and provision of services - C-465/05 ECJ 13.12.07

Articles 43 and 49 of the EC Treaty require that there be no restriction on the freedoms of establishment and provision of services across member states. The only exception allows for non-discriminatory restrictions, which proportionately achieve objectives justified by overriding reasons in the general interest.
