S v General Medical Council - doctor's illness could not excuse misconduct - QBD 17.12.07

The Fitness to Practice Panel struck Dr S off the Medical Register due to misconduct, which included harassment. The High Court (Collins J) has dismissed his appeal.

The Court noted that the Panel had been made aware that Dr S was suffering alcoholism and depression at the time. He had been advised to seek help and had not done so. Dr S's conduct fell far below the standard to be expected of a registered medical practitioner. The Panel acted properly in deciding that his own medical problems could not be taken into account when considering the appropriate sanction.
