Airbus UK Ltd v Webb - dismissal is
Airbus dismissed Mr Webb for misconduct. In so doing they took account of a 12 month warning given 13 months before - in other words a warning which had expired. An employment tribunal, relying on previous authority (Diosynth Ltd v. Thomson), held that the dismissal must be unfair for this reason. The EAT agreed (see its decision of 14 February 2007.) Airbus appealed to the Court of Appeal.
