Gascoigne v Secretary of State for Children, Schools & Families - CST cannot look at circumstances behind police caution - Care Standards Tribunal 27.3.08

Mr Gascoigne appealed against his inclusion on the PoVA and PoCA lists. The Care Standards Tribunal rejected the Secretary of State's application to strike out the appeal and directed that it should be heard by a full CST. It did this because the Secretary of State's decision appeared to be based solely on the fact that Mr Gascoigne had accepted a police caution in respect of sexual offences against a minor. In the CST's view there was other evidence to consider as well.
