Kutzel v Roche Products Ltd - the burden of proof in unfair dismissal cases - Court of Appeal 17.4.08
Roche dismissed Dr Kuzel in March 2005. At the employment tribunal Roche argued that her dismissal was fair, as being for "some other substantial reason" (her breach of trust). Dr Kuzel claimed that she was really dismissed for making protected disclosures about activities at Roche. If so her dismissal would be automatically unfair and there would be no cap on her compensation.
