Boyd v Renfrewshire Council - given findings of fact, tribunal's decision was not one that no reasonable tribunal could have reached - Court of Session 11.6.08
Mr Boyd, a refuse collection driver, was dismissed for misconduct consisting of taking an unauthorised break and failing to complete the days tasks. The Tribunal found his dismissal was unfair but the Scottish EATon 3 July 2007 reversed that. It said that the Tribunal had substituted its own view that dismissal was not the appropriate sanction, and failed to take account of the range of reasonable responses open to the employer. Dismissal was at the harshest end, but not outside that range.
